How to Sell a Financed Car in the Philippines Safely and Avoid Pasalo Scams
Selling a car that still has an outstanding bank or financing balance is possible in the Philippines, but it cannot be handled like an ordinary sale of a fully paid vehicle.
The lender still has a security interest in the car, and the original borrower generally remains responsible for the loan until it is fully settled or the lender formally approves another arrangement.
Most important rule: Do not release the car, keys, original documents or signed sale documents based only on a promise that another person will continue paying the loan.
PNP–Highway Patrol Group operations reported in March and April 2026 involved vehicles linked to financing fraud, assumed-balance schemes and falsified documents. The Bangko Sentral ng Pilipinas has also warned the public about pasalo-benta or assume-balance scams.

Quick Answer: Can You Sell a Car That Is Still Financed?
Quick answer: Yes. Obtain a current full-settlement amount from the lender and complete the settlement through the lender’s official process before releasing the vehicle under the agreed transaction conditions. What Does “Encumbered” Mean?
An encumbered vehicle remains subject to a lender’s security interest because the financing has not yet been fully settled or formally released. The borrower may be the registered owner and may possess the car, but the lender continues to have rights over it while the chattel mortgage is in force.
Under the Philippine Chattel Mortgage Law, mortgaged personal property generally cannot be sold or pledged while the mortgage remains in force without the mortgagee’s written consent. Always confirm the lender’s own settlement and release requirements before proceeding.
The following do not prove that the loan has been transferred or cleared:
- A buyer’s promise to continue the monthly amortization.
- A signed or notarized Deed of Sale.
- A payment screenshot or pending transfer.
- Complete-looking OR/CR documents.
- An initial cash payment to the seller.
Why an Informal Pasalo Arrangement Is Risky
Not every person proposing a pasalo arrangement is necessarily a scammer. The problem is that an informal, lender-unapproved arrangement can transfer possession of the vehicle without transferring the debt.
How the Original Borrower Can Become Trapped
- The owner needs to sell a vehicle with an outstanding loan.
- A buyer or intermediary offers an initial payment and promises to continue the instalments.
- The seller releases the car, keys, IDs or signed documents before the lender approves or receives full settlement.
- The vehicle is resold, pledged or passed to another person, sometimes using incomplete, altered or falsified documents.
- The promised payments stop, but the loan remains under the original borrower’s name.
- The lender continues collection or recovery action against the original borrower, who may no longer know where the car is.
Key point: A Deed of Sale can document a vehicle transaction. It does not automatically replace the borrower named in the financing agreement.
Warning Signs Before You Release the Car
- The buyer wants to continue your loan without involving the lender.
- You are pressured to release the car or sign documents on the same day.
- You are asked to sign a blank or open Deed of Sale.
- The actual final buyer is not identified.
- Screenshots are presented as the only proof of payment.
- The registered owner is told that they do not need to participate.
- The buyer gives unclear answers about who will settle the loan and when.
One warning sign does not automatically prove fraud, but several warning signs together should be treated seriously.
An informal pasalo can transfer possession of the car without transferring the loan.
Why a Clean-Looking OR/CR Is Not Enough
The Official Receipt and Certificate of Registration are important vehicle documents, but their appearance alone does not prove that an outstanding loan has been settled. Documents may also be altered, used without permission or presented before the lender completes its release process.
Check the vehicle documents, but verify the loan directly with the bank or financing company. The strongest evidence should come from the lender, including a current Statement of Account for Full Settlement, official payment instructions, confirmation that payment has been applied to the correct account, and the applicable release documents after settlement.

How to Sell a Financed Car Safely
Step 1: Request an Updated Full-Settlement Statement
Ask the bank or financing company for a current Statement of Account for Full Settlement. Confirm the total amount, quotation validity, penalties or charges, official payment channel, clearing requirements, and the expected timing for releasing the original documents and cancelling the encumbrance.
Step 2: Obtain a Proper Vehicle Valuation
The car’s current value depends on its model, year, mileage, mechanical and exterior condition, accident and repair history, service records, documents and dealer demand. A proper appraisal lets you compare the expected offer with the settlement amount.
Step 3: Compare the Offer With the Outstanding Balance
If the offer is higher than the settlement amount, the loan can be settled from the vehicle proceeds and the balance can be paid to the seller.
If the offer is lower than the settlement amount, the seller will normally need to cover the shortfall before the lender can release its interest in the vehicle.
Step 4: Document the Payment and Settlement Flow
Before any payment or handover, record who will pay the lender, the exact settlement amount, how any seller shortfall will be handled, how the remaining proceeds will be paid, and the conditions for releasing the vehicle, keys and documents.
Step 5: Verify That the Loan Payment Has Cleared
Use the lender’s official payment process. A screenshot, transfer instruction or deposit slip is not final proof that the loan has been settled. Confirm that the payment was received and applied to the correct account.
Step 6: Complete the Sale and Handover Records
Complete accurate transaction documents, including the Deed of Absolute Sale, payment acknowledgement and vehicle handover acknowledgement. The handover record should identify the car, seller, receiving party, date and time, keys and documents released, payment reference and vehicle condition.
The exact handover timing should follow the documented transaction arrangement and lender requirements. Never release the vehicle solely because a payment appears to have been initiated.

From a ₱500,000 dealer offer, ₱150,000 settles the loan and ₱350,000 is paid to the seller.
What If the Offer Is Lower Than the Loan Balance?
If the final offer is ₱500,000 but the lender requires ₱550,000 for full settlement, the seller would normally need to provide the ₱50,000 shortfall, plus any applicable lender charges, before settlement can be completed.

- Valid government-issued IDs of the registered owner.

- All vehicle keys and available service records.
